John has conducted successful mediations since 2002 ranging from £100,000 to £4m. In Personal Injury, Major Claims Handling: Cost Effective Case Management, Goldrein de Haas & Frenkel (Butterworths July 2000), John advocated mediation of clinical disputes because of the flexibility and creative remedies in contrast to the limited orders for damages and costs in litigation. With a more effective NHS complaints process, there is very little further evidence that needs to be prepared for the parties to properly assess the issues and quantum in order to bring matters to a speedy economic resolution in the interests of all parties. Mediation is the obvious solution to reducing disproportionate time and costs arising in all parties best interests.

Professional Background

John qualified in 1976 in the City and moved to Brachers in 1981 where he has acquired 30 years experience in personal injury and clinical negligence. He was Liaison Partner to the NHS Litigation Authority for clinical and personal injury claims for ten years from 1988 to 2008 and Mediation Initiative Partner from 2002 to 2008. He currently lectures and advises on selected health topics including mental health and capacity, consent, clinical negligence, inquests, witness skills for healthcare professionals, health and safety and the legal implications of record keeping. He was managing partner of the firm from 2004 – 2012 and has undergone refresher training in commercial mediation to renew his skills with ADR Group. He is the current chair of the Law South Board.
